Terms and Conditions of the Online Store [www.cloudwear.pl](https://www.cloudwear.pl)

§1 General provisions

  1. Cloud Wear Sp. z o.o., with its registered office in Pabianice, operates the Online Store at [www.cloudwear.pl](https://www.cloudwear.pl). Cloud Wear was entered in the National Court Register on 26.02.2026, Tax ID (NIP): 7312096031, REGON: 544075650.
  2. These terms and conditions are addressed to the Consumer and define the procedure and rules for concluding a Sales Agreement via the Online Store.
  3. In order to use the Store, browse the assortment and conclude a Sales Agreement, it is necessary to: have a device with internet access and a web browser, consent to the use of cookies, and have an active e-mail account.
  4. The Customer may communicate with the Seller via:

    • phone: 727 777 701,
    • in writing to the Seller's address (ul. marsz. Józefa Piłsudskiego 7/21, 95-200 Pabianice, Poland).
  5. The Customer may create an Account at [www.cloudwear.pl](https://www.cloudwear.pl) in order to have access to their order history. The Customer is not required to create an Account in order to browse the store's assortment and place an order.
  6. Prices given in the Store are expressed in Polish zloty (PLN) and include VAT (gross price). Product prices do not include the cost of delivery.
  7. The Seller has the right at any time to change the prices of goods, grant a discount on the entire assortment or individual products, or withdraw goods.
  8. The Customer may place an order via the Store for delivery to the following countries: Poland, Austria, Belgium, Bulgaria, Czech Republic, Denmark, France, Spain, the Netherlands, Ireland, Luxembourg, Germany, Portugal, Slovakia, Slovenia, Sweden.

§2 Definitions

  1. Business days – each day from Monday to Friday, excluding public holidays,
  2. Delivery – the act of delivering to the Customer the Goods specified in the Order,
  3. Customer – any person placing an Order via the Store,
  4. Account – the Customer's Account, which they may create in the Store; it stores their data and order history,
  5. Consumer – a natural person performing a legal act with an entrepreneur (e.g. concluding an Agreement) not directly related to their business or professional activity,
  6. Newsletter – up-to-date information about products and the Store sent via e-mail,
  7. Terms and Conditions – this document,
  8. Store – the online service through which the Seller operates the Online Store, available at: https://cloudwear.pl/,
  9. Seller – Cloud Wear Sp. z o.o. with its registered office in Pabianice, ul. marsz. Józefa Piłsudskiego 7/21, Tax ID (NIP): 7312096031, REGON: 544075650, KRS: 0001226576,
  10. Goods – tangible goods intended for sale, here: clothing,
  11. Agreement – the sales agreement concluded electronically on the terms set out in the Terms and Conditions, between the Customer and the Seller,
  12. Ordering – a declaration of the Customer's will aimed at concluding a Sales Agreement for the Goods via the Store.

§3 Creating an Account in the Store

  1. Creating an Account is completely free of charge.
  2. In order to create an Account in the Store, it is necessary to fill in the registration form.
  3. On the Website it is necessary to provide an e-mail address, to which a login and a temporary login password are sent.
  4. After logging in with the above-mentioned data, the Customer may edit the password and account details, and change their personal data. The Customer may edit this data each time after logging in.

§4 Placing Orders

  1. Customers may place Orders around the clock.
  2. In order to place an order, the Customer selects the product they are interested in and clicks the "ADD TO CART" button, and then follows the subsequent steps based on the messages appearing on the page.
  3. After placing an order, the Customer receives an automatic e-mail confirming the placed order – together with information about the ordered products and the method of delivery.
  4. For orders over 600 zł, the Customer does not bear the cost of delivery when the order is paid for in advance.
  5. In order to modify or cancel an order, the Customer should contact the Seller by e-mail immediately after placing it.

§5 Available payment and delivery methods

The following payment methods are available to the Customer in the Store:

  • Apple Pay

  • Blik
  • Mastercard
  • Visa
  • Przelewy24
  • PayPo

§6 Order Fulfilment

  1. A requirement for the fulfilment of an Order placed by the Customer is the correct entry of personal and contact details.
  2. If the Customer fills in the Order form incorrectly or incompletely, the Seller will attempt to make contact in order to confirm or complete the data. If the Seller is unable to make contact within 7 days, the Order will be cancelled and the funds returned to the account from which the payment was made.
  3. The Order fulfilment process begins immediately after the payment is credited to the Seller's account.
  4. The delivery time depends on the current number of Orders. Orders are fulfilled chronologically.
  5. Confirmation of the conclusion of the sales agreement is the VAT invoice, which is issued and sent to the Customer electronically to the e-mail address provided in the order.
  6. Orders are packed in a cardboard box and shipped via InPost.
  7. Upon receiving the Order, the Customer is obliged to verify that the parcel has not been damaged and is consistent with the order.

§7 Right of Withdrawal from the Agreement

  1. The Consumer may withdraw from the Sales Agreement without giving any reason by submitting an appropriate declaration within 14 calendar days.
  2. The time for return is counted from the moment the Goods are delivered to the Customer.
  3. The Consumer is obliged to inform the Seller of their decision to withdraw from the Agreement electronically (via e-mail).
  4. The Consumer may use the model withdrawal form.
  5. Upon withdrawal from the Agreement, the Seller is obliged to immediately return all payments received from the Consumer, including the costs of delivering the Goods.
  6. The Consumer is obliged to return the Goods immediately, and certainly no later than 14 days from the day on which they withdrew from the Agreement.
  7. The Seller may withhold the refund of the payment made by the Consumer for the Goods until they have been received.
  8. Refunds are made using the same payment method the Customer used to pay for the order.
  9. The costs of returning the Goods are covered in full by the Buyer.
  10. The Seller may withdraw from fulfilling an order if an error appears in the final amount when the Consumer places the order. The Seller will cancel such an order and return the incorrectly collected amount to the Consumer.
  11. If the Customer fails to collect the parcel and it is returned to the Seller, the Customer is obliged to cover the costs of shipping to the Customer and the costs of the return shipment, even if the shipment to the Customer was free as part of free delivery for orders over 600 zł.

If the Customer notices any irregularities regarding the delivered parcel, they should immediately report this to the Seller or (if the courier is present during verification of the parcel) refuse to accept the Goods.

§8 Complaints

  1. The Customer has the right to submit a complaint about purchased Goods if they turn out to be non-compliant or defective.
  2. The Customer submits a complaint by e-mail to info@cloudwear.pl.
  3. It is recommended that the complaint include information such as: the details of the Customer submitting the complaint, a description of the defect, the circumstances in which it occurred or could have occurred, and the Customer's request related to the defect of the Goods.
  4. The Consumer is obliged to immediately send back the Goods under complaint, at the Seller's expense. To do so, please contact the Seller (by e-mail or phone).
  5. The Seller will respond to the complaint request immediately – no later than within 14 calendar days from the date of receiving the complaint.

§9 Consent to collecting reviews

  1. A Customer of the Online Store has the option of voluntarily and free of charge submitting a review of purchases made in the Online Store. The subject of a review may also be a rating, photo or review of a product purchased in the Online Store.
  2. After purchases have been made in the Online Store, the Seller provides the data necessary to create an e-mail invitation to the company handling the survey process. The sending of surveys and the process of collecting reviews in forms is handled entirely by TrustMate SA, with its registered office at Bartoszowicka 3, 51-641 Wrocław. TrustMate SA sends the Customer an e-mail asking them to submit a review, together with a link to the online form enabling them to do so – the online form makes it possible to answer the Seller's questions about the purchases, rate them, add their own description of the review and a photo of the purchased product. If no review is submitted after receiving the first invitation to submit a review, TrustMate may resend the invitation.

§10 Final Provisions

  1. Agreements concluded through the Store are concluded in the Polish language.
  2. In matters not regulated by the Terms and Conditions, the provisions of generally applicable law apply, in particular the provisions of the Civil Code and the Act of 30 May 2014 on Consumer Rights.
  3. The Seller reserves the right to introduce changes to the Terms and Conditions. Agreements concluded before changes are made to the Terms and Conditions are governed by the Terms and Conditions in force on the date of conclusion of the Agreement.
